Welcome to Kyven
These Terms of Service govern your use of Kyven ("we," "us," "our," or "the Service"). By creating an account or using Kyven, you accept these terms.
What Kyven Does
Kyven is an AI-powered personal assistant that:
- Remembers your conversations and learns your preferences
- Provides intelligent suggestions and reminders
- Offers voice interaction
- Integrates with third-party services you choose to connect
- Uses location data (with your permission) for context-aware features
We may modify features or temporarily suspend the Service for maintenance. We'll do our best to notify you in advance.
Who Can Use Kyven
You must be at least 13 years old (16 in the EU) to use Kyven. If you're under 18, you need parental consent. You must also:
- Have the legal capacity to enter into contracts
- Not be prohibited from using the Service under applicable laws
- Agree to use the Service responsibly and lawfully
Your Account
Creating an Account
When you create an account:
- Provide accurate information
- Keep your recovery code secure and backed up
- Don't share your account with others
- You're responsible for all activity under your account
Recovery Code
Your recovery code is the only way to restore your account on a new device. We can't recover lost codes, so keep it safe.
Subscription and Payment
Free Trial
New users get 3 months free with full Pro features. No credit card required. The trial ends automatically after 3 months.
Pricing
After your trial:
- US/EU: $6.99 per month
- India: ₹199 per month
Prices include applicable taxes and are in local currency.
Billing
- Subscriptions automatically renew
- We charge your payment method on each renewal date
- Cancel anytime in Settings
- Cancellation takes effect at the end of your billing period
Refunds
Payments are non-refundable, except as required by law. If you cancel, you keep access until your paid period ends.
How to Use Kyven Responsibly
You agree not to:
- Violate any laws or regulations
- Infringe on others' rights
- Use the Service for illegal, harmful, or abusive purposes
- Attempt to gain unauthorized access to our systems
- Reverse engineer or copy the Service
- Use automated systems without permission
Your Content
You own everything you share with Kyven. By using the Service, you grant us permission to:
- Store and process your content to provide features
- Make backups for data protection
- Display your content back to you across devices
You're responsible for the accuracy and legality of content you provide.
Intellectual Property
Kyven, our logo, and all related materials are owned by us or our licensors. We grant you a limited license to use the app for personal, non-commercial purposes. This license doesn't allow you to:
- Copy, modify, or create derivative works
- Distribute or sell the Service
- Remove proprietary notices
- Use Kyven commercially without permission
AI Service Disclaimer
Important Limitations
Kyven uses artificial intelligence, which has inherent limitations. The AI may produce incorrect or incomplete information.
Not Professional Advice
Kyven doesn't provide:
- Medical, health, or mental health advice
- Legal advice or counsel
- Financial or investment advice
- Professional services of any kind
Always consult qualified professionals for important decisions.
Not for Emergencies
Kyven is not an emergency service. In emergencies, call your local emergency number (911, 112, etc.). Kyven cannot contact emergency services on your behalf.
Service Availability
Kyven is provided "as is." We don't guarantee:
- Uninterrupted or error-free service
- Complete accuracy of information
- Freedom from viruses or harmful code
You're responsible for determining if Kyven meets your needs and maintaining backups of important information.
Limitation of Liability
To the maximum extent permitted by law, Kyven is not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or use
- Personal injury or property damage
Our total liability won't exceed the greater of $100 or amounts you paid in the past 12 months.
These limitations don't apply to liability for death or personal injury caused by negligence, fraud, or where prohibited by law.
Termination
By You
Stop using Kyven and delete your account anytime in Settings. Your data will be permanently deleted within 30 days.
By Us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law.
Dispute Resolution
If you have a dispute, contact us first at legal@hellokyven.com. We'll try to resolve it within 60 days.
If informal resolution fails, disputes will be resolved through binding arbitration, except for small claims court actions or intellectual property disputes.
Class Action Waiver
You agree to bring claims only individually, not as part of a class action or representative proceeding.
General Terms
Changes to Terms
We may update these Terms. Material changes will be communicated through the app or email. Continued use after changes means you accept them.
Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.
Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Kyven.
